Terms of Service

These terms are the agreement between you and Temperance. They cover what you can expect from us, what we ask of you, and the rules that keep the service working for everyone. We have kept them in plain words so you can actually read them.

By creating an account or using Temperance, you agree to these terms. If you do not agree, please do not use the service. If you are using Temperance for an organization, you confirm you have the authority to accept these terms on its behalf.

Who we are

Temperance is built and operated by its founders, Arshawn Arbabi and William Dorman. When these terms say "we", "us", or "Temperance", that is who we mean. When they say "you", they mean the person using the service.

Who can use Temperance

Temperance is meant for adults. You need to be at least 16 to use it, and old enough to enter a binding agreement where you live. By using the service, you confirm that you are.

You are responsible for following any laws that apply to you when you use Temperance.

What Temperance does

Temperance is a personal assistant. You talk to it in plain language, and it helps you manage your calendar, your to-dos, and a private second brain of notes and other things you ask it to keep. It can read and change those things on your behalf when you ask.

Temperance is a tool to help you, not a replacement for your own judgment. You decide what to act on. We are always improving the service, so features may change, and we will tell you about anything important.

Your account

You need an account to use Temperance, and sign-in is handled by our authentication provider. Keep your login details safe, since anything done through your account is treated as done by you.

Give us accurate information when you sign up, and let us know if you think someone else has gained access to your account so we can help.

Using Temperance fairly

We ask that you use Temperance for its purpose and not in ways that harm others or the service. In particular, please do not:

  • Break the law, or use the assistant to help you break it.
  • Try to access other people's accounts or data.
  • Probe, attack, or disrupt the service or the systems behind it.
  • Reverse engineer or copy the service except where the law allows it.
  • Resell or rent access to Temperance without our written agreement.
  • Upload content that infringes someone else's rights, or that is harmful or abusive.

If you misuse the service in a way that puts other users or the service at risk, we may suspend or close your account.

Your content stays yours

The calendar events, tasks, notes, and other content you put into Temperance belong to you. We do not claim ownership of it. You give us permission to store and process that content only so we can run the assistant for you, exactly as described in our Privacy Policy.

You are responsible for the content you add, and for having the right to use it. We do not sell your content, and we do not use your personal content to train AI models.

Connected services

Temperance works with services you choose to connect, such as your calendar, and relies on providers like our AI, authentication, hosting, and payment partners to run. When you connect an outside service, you are also bound by that service's own terms.

We are not responsible for outside services we do not control. If one of them changes or stops working, parts of Temperance that depend on it may change too.

AI and its limits

Temperance uses a large language model to understand your requests and act on them. AI can be wrong, and it can misunderstand. Please check anything important before you rely on it, especially when the assistant is about to make a change you cannot easily undo.

You stay in control. The assistant acts on what it understands from you, and you are responsible for the actions you ask it to take.

Plans and payment

Temperance may offer free and paid plans. If you subscribe to a paid plan, you agree to pay the fees shown when you sign up. Our payment processor handles your card, and we never see or store your full card number.

Unless we say otherwise, subscriptions renew automatically for the same period until you cancel. Prices may change, and we will give you notice before a change affects you.

Cancelling and refunds

You can cancel your subscription at any time. Your paid features stay active until the end of the period you have already paid for, and we will not bill you again after that.

Except where the law requires a refund, payments already made are not refundable. If something goes wrong on our side, write to us and we will make it right.

The service is provided as is

We work hard to keep Temperance reliable, but we provide it "as is" and "as available". We do not promise it will always be uninterrupted, error free, or fit for a particular purpose, beyond what the law requires us to guarantee.

Limits on our liability

To the extent the law allows, Temperance and its founders are not liable for indirect or consequential losses, or for lost data or profits, arising from your use of the service. Our total liability to you is limited to the amount you paid us in the twelve months before the claim.

Nothing in these terms limits liability that cannot be limited by law.

Ending the agreement

You can stop using Temperance and delete your account at any time. When you delete your account, we delete your data as described in our Privacy Policy.

We may suspend or end your access if you break these terms, if it is needed to protect the service or other users, or if we stop offering the service. Where we reasonably can, we will give you notice first.

Changes to these terms

We may update these terms as the service grows. If we make a meaningful change, we will update the date at the top and let you know. If you keep using Temperance after a change takes effect, that means you accept the new terms.

Governing law

These terms are governed by the laws of the State of Texas, United States, and any disputes will be handled by the courts there, unless the law where you live gives you the right to use your local courts.
